Cancellation Policy

If you want to cancel your booking, please contact us as soon as possible. Cancellation may not be possible depending on the timing of your request and any cancellation is at our discretion.

A 40% deposit is required at the time of booking. This amount is non-refundable under any circumstances.

If cancellation is made less than 6 weeks before the start of the retreat, no refund will be given.

We strongly recommend taking out travel insurance to cover any unforeseen circumstances.

Our cancellation policy exists to cover costs with our vendors and to compensate us for the risk of not being able to resell your spot.

Terms and conditions of sale

1. Interpretation

The following definitions apply in these Conditions.

Business Day: a day other than a Saturday, Sunday or official public holiday in Mexico.

Charges: the amounts payable by the Customer in accordance with clause 4.

Contract: the contract between Feelnest and the Customer for the supply of Services.

Customer: the person who purchases Services from Feelnest; "you".

Intellectual Property Rights: patents, copyrights, trademarks, domain names, trade secrets and all other intellectual property rights, whether registered or unregistered.

Services: the experiences, events, goods and services made available by Feelnest to the Customer.

Payment Platform: Stripe and/or bank transfer (SPEI).

2. Contract for Services

2.1 The booking constitutes an offer by the Customer to purchase Services in accordance with these Conditions.

2.2 These Conditions apply to all bookings you make with us.

2.3 The booking shall only be deemed accepted when Feelnest issues a Booking Confirmation, at which point the Contract shall come into existence.

2.4 These Conditions apply to the Contract to the exclusion of any other terms the Customer seeks to incorporate.

2.5 Any quotation issued by Feelnest does not constitute an offer.

2.6 Payments are processed through Stripe and/or bank transfer (SPEI). Any questions, complaints or cancellation requests must be directed to Feelnest directly.

3. Customer's Obligations

3.1 The Customer shall ensure that the booking information provided is complete and accurate; cooperate with Feelnest in all matters relating to the Services; and provide any information reasonably required to process the booking.

3.2 Bookings may only be made by individuals who are 18 years or over. You may book on behalf of yourself or another person; the person making the booking is responsible for all payments. Certain Services may be designed for specific profiles — please review the criteria before booking.

3.3 The Customer is responsible for the safety of their personal belongings during participation in the Services. Feelnest accepts no responsibility for loss or damage to personal belongings.

3.4 Feelnest accepts no liability for incorrect information provided by the Customer.

3.5 ASSUMPTION OF RISK: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CUSTOMER VOLUNTARILY ASSUMES ALL RISKS, KNOWN AND UNKNOWN, OF PARTICIPATING IN THE SERVICES, EVEN IF SUCH RISKS ARISE FROM THE NEGLIGENCE OF FEELNEST OR DEFECTS IN EQUIPMENT OR FACILITIES.

3.6 Release and Waiver. The Customer acknowledges that they have reasonably assessed the risks involved, that they are solely responsible for determining their fitness to participate, that they will not participate if they have any physical, medical or mental limitation that prevents them from doing so safely, and that they will act responsibly and comply with all provided directions and precautions.

4. Charges and Payment

4.1 The price of the Services will be as stated at the time of booking, except in cases of obvious error.

4.2 A 40% deposit is required at the time of booking and is non-refundable.

4.3 The remaining balance must be paid by the date indicated in the booking confirmation. In the event of non-payment, Feelnest reserves the right to cancel the booking.

4.4 Payments can be made via Stripe (credit/debit card) or bank transfer (SPEI).

4.5 The Customer is solely responsible for any additional local taxes that may apply (VAT or otherwise).

4.6 Unless expressly stated, prices do not include insurance, flights, transfers, visas, vaccinations or personal expenses (laundry, calls, drinks, tips, etc.).

4.7 If payment is made in a currency other than Mexican pesos, the exchange rate in effect at the time of payment will apply.

5. Intellectual Property

5.1 All copyrights, trademarks and other intellectual property rights over Feelnest's materials remain at all times vested in Feelnest. Use is permitted only as expressly authorized.

5.2 Materials are for personal, non-commercial use only. Reproduction, distribution or commercial exploitation without express authorization is strictly prohibited.

6. Travel Information and Insurance

6.1 Feelnest is not responsible for managing passport, visa or other travel document requirements. It is the Customer's responsibility to verify these with the relevant authorities.

6.2 We strongly recommend taking out travel insurance covering the risks associated with the Services, including medical assistance, repatriation, accident or death.

7. Cancellation by the Customer

7.1 Cancellation requests must be submitted to Feelnest as soon as possible. Any such request is at the sole discretion of Feelnest.

7.2 If Feelnest accepts a cancellation, applicable charges will apply. If the cancellation affects more than one person on the booking, the charge applies per person.

7.3 Any refund will be made less any payment processing fees incurred.

8. Change of Booking by the Customer

8.1 If you wish to modify the date, destination, accommodation or any element of your booking, you must contact Feelnest. Any change is at Feelnest's sole discretion.

8.2 Changes are subject to availability and may incur additional fees, which tend to increase the closer to the start date the change is made.

9. Cancellation by Feelnest

9.1 In exceptional circumstances, Feelnest may be required to cancel a Service. The Customer will be notified as soon as possible. Feelnest may offer an alternative Service or a full refund, less any payment processing fees.

10. Change of Booking by Feelnest

10.1 Feelnest reserves the right to make modifications to the Services at any time. Most changes are minor.

10.2 In the event of a significant change, the Customer may: (a) accept the change; (b) reject it and terminate the Contract with a full refund less processing fees; or (c) reject it and opt for an alternative Service if one is offered.

11. Unavoidable and Extraordinary Circumstances

11.1 Feelnest shall have no liability to the Customer if it is prevented from fulfilling its obligations by circumstances beyond its reasonable control, including natural disasters, war, epidemics, pandemics, government orders, fire or flooding.

11.2 The Customer is advised to ensure they have appropriate travel insurance covering this type of circumstance.

12. Limitation of Liability

12.1 The Customer's statutory rights as a consumer remain unaffected.

12.2 Feelnest accepts no liability for claims, losses or damages, except in cases of fraud or negligence by Feelnest causing death, injury or illness.

12.3 Any complaint must be submitted in writing within 30 days of the end of the retreat.

13. Indemnification

13.1 If you or anyone on your behalf makes a claim against Feelnest in relation to a Service, you agree to indemnify and hold Feelnest harmless from any liability, demand, loss or cost arising from such claim.

14. Disclaimer of Warranty

14.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEELNEST PROVIDES THE SERVICES "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

15. General

15.1 Assignment: Feelnest may transfer its rights and obligations to another organization.

15.2 Variations: Feelnest may amend these terms at any time. We recommend reviewing them each time you use our services.

15.3 Waiver: If Feelnest does not immediately enforce any obligation under these terms, this does not constitute a waiver of the right to enforce it in the future.

15.4 Validity: If any part of these terms is found to be unlawful, the remainder will continue in full force.

15.5 Governing Law: These Conditions shall be interpreted in accordance with the laws of the United Mexican States. Any disputes shall be resolved exclusively before the competent courts of Mexico City.
